What you Need to Know to understand our Terms and Conditions
Before joining the RErights community, you must accept our Terms and Conditions (T&Cs for short).
‘What are Terms and Conditions?’, we hear you ask. Terms and Conditions are the things we need to all agree on before we work together. They include the ways RErights will respect you and the content you upload; the ways you must respect RErights and RErights content; and how we will all respect other people’s rights along the way.
The Terms and Conditions are quite long! You should read the T&Cs with an adult before you sign up. But first, some information that will help you understand them. Put simply, the T&Cs are about being nice and acting responsibly, being careful with people’s personal information, and being clear about where our responsibilities begin and end.
Being Respectful 1 – User Agreements
When you use the RErights website, you agree to be respectful to others, to use the website the way it is meant to be used, and to make sure your account is secure. This means listening to what other members have to say, even if you don’t agree with them; respecting people’s privacy in discussions with others; and not sharing your login details with other people. It means no bullying on the website, no illegal activities, no offensive posts, no off-topic activities like advertising or spamming, and no sharing of content that belongs to someone else. It’s simple really, just ask yourself: Am I being nice? Am I acting responsibly? If you break your agreement to be nice and act responsibly, we can take your content down, or cancel your RErights account.
Being Respectful 2 – Copyright and Intellectual Property (IP)
The internet makes it easy to share content. ‘Copyright’ and ‘Intellectual Property’ (IP) are words that help us talk about how to respect whoever created the content that’s being shared. When you create a text or image or artwork, you own the ‘copyright’ – the right to decide when and how others can ‘copy’ or share it. When you have an idea or some special knowledge, it’s called Intellectual Property, and it belongs to you until you choose to share it. For RErights, both you and the RErights team will create content and share knowledge. So we need to all agree on how to treat copyright and IP. We can guess some, but not all of the ways that we might want to share content with each other. So the T&Cs include an agreement that we will all do our best to be fair to each other; and they explain the ways we can share your content. You need to agree not to upload anything you don’t want us to share, or that doesn’t belong to you.

When making any agreement, it’s impossible to think of everything that might happen and to have a plan for everything. And on the internet, especially, there is always a small risk for the user. For this reason, Terms and Conditions almost always include a Disclaimer – this is a legal section where an organisation says: We promise to do our best, to be fair, and to be careful, but as the user, you must accept the risk of taking part in the project.
The explanation above is not a replacement for the Terms and Conditions. You still need to look at the T&Cs below with an adult. But hopefully, reading this first makes it much easier!
The terms and conditions that follow were developed in English and have been professionally translated into Spanish and French. If you are using this site in another language, it’s important you understand that the Terms and Conditions have been machine translated and may contain some errors. Where a dispute as to meaning arises between English and foreign language translations of these terms and conditions, the English version shall prevail. Welcome to RErights. These Terms and Conditions (Terms) apply to the use of RErights. By accessing or using RErights, you will be deemed to accept these Terms. If you do not wish to accept these Terms, you must not use RErights.
PLEASE NOTE if you are under 18, you must ensure you have the consent of your parent or guardian to enter and upload content prior to joining this site. Please refer to our section on the website ‘For Parents and Guardians’ to ensure that all appropriate consents are obtained. Consents must be obtained in relation to all individuals who submit content or who appear in content submitted (such as images and videos).
References to ‘you’ in these Terms refer to participants and their parents or guardians providing consent (where applicable).
RErights is part of a research project being carried out by Western Sydney University and the Young and Well Cooperative Research Centre in partnership with Voices of Youth and Digitally Connected (RErights, ‘we’ or ‘us’).
RErights explores young people’s understandings of how their rights are related to their use of digital media (such as computers, internet and other digital technologies including television, radio, cameras and video recorders).
Participants who choose to take part in the research through creating an account complete a series of activities by uploading text, photos and videos to the website. Participants will be asked to answer questions about different topics – for example, about their use of and access to technology, their rights, or their privacy.
The website is designed for teenagers. Younger people (under age 12) can also join but they may need more help or find it easier to participate as part of a group. If you are older than 18, you cannot submit content unless you are uploading on behalf of a group of under 18s. This is to make sure that young people lead the conversations and the direction of the website, and that their voices are heard clearly.
Content submitted to RErights may be used to create new materials for sharing via the website or partners’ websites and social media channels, or for inclusion in research outputs (such as reports, presentations or publications, in print or online).
The research team will only refer to participants’ age, gender and country in packaged materials and research outputs, which may also include their image. Names and email addresses will be kept confidential.
All content submitted to this website is uploaded to a Dropbox account and subsequently transferred to a secure storage area hosted by Western Sydney University.
As a user of RErights, you agree to be bound by these Terms. The Terms may be modified at any time under the sole discretion of the RErights team. By continuing to access RErights after the revisions become effective, you agree to be bound by the revised Terms.
The contents of this website are licensed under a Creative Commons Attribution-Noncommercial-ShareAlike 4.0 International licence, unless otherwise specified (Licence). For further details of the terms of such Licence please see Creative Commons licence terms.
As a condition of your use of RErights, you warrant to us that you will not use RErights for any purpose that is prohibited by these Terms. In particular, you agree you:
- are responsible for your use of RErights;
- have obtained the consent of a parent or guardian if you are under 18 years old;
- accept full responsibility for any unauthorised use of RErights by minors under 18 years old;
- will not transfer your RErights account to anyone;
- are solely responsible for all data or network charges incurred using RErights;
- are responsible for maintaining the confidentiality of your RErights password;
- will not disclose your password to any third party or breach the security of your password;
- will not use your RErights account to engage in any illegal conduct or activity or to defame, abuse, cyber-bully, harass, stalk, threaten or otherwise offend any person;
- will not publish, distribute, email, transmit or disseminate any material which is unlawful, obscene, defamatory, indecent, offensive or inappropriate;
- will not engage in or promote any third party surveys, contests, pyramid schemes, chain letters, unsolicited emailing or spamming via RErights;
- understand that content is public and not deemed confidential;
- will respect the perspectives and worldviews of other participants;
- will not impersonate any other person or entity;
- will not upload, post, email, transmit or otherwise make available using RErights, any material that you do not have a right to make available;
- will not upload, post, email, transmit or otherwise make available using RErights, any material unless consents have been obtained from all those that appear in such content (or their parents or guardians, where applicable); and
- will not breach any laws which are applicable to your use of RErights in your jurisdiction.

Website moderators retain the right to remove anything deemed to be inappropriate or offensive. All content will be consistently moderated.
We reserve the right to remove, reclaim or force forfeiture of any username and account at any time and for any reason, including but without limitation to, usernames which are offensive, violate our Intellectual Property rights, or which may mislead other users.
RErights may also link to third-party sites. These links may or may not be our affiliates, and please note that we have no control over, and assume no responsibility for, content, privacy policies or practices of third-party sites. By agreeing to these Terms, you acknowledge that we are not responsible or liable, directly or indirectly, for any damage incurred by interaction with third-party sites. We encourage all users to read the terms and privacy policies of any third-party sites that may be visited.
All intellectual property rights in RErights, including the website, all trade marks (whether registered or not) and copyright in all materials, together with all content uploaded to the site (such as comments, videos, photos or drawings) (collectively Intellectual Property) is the property of RErights and its partner organisations. RErights may copy, distribute and publish content submitted for the purposes of the research and for inclusion in a report compiled by us as an outcome of the research.
You acquire no rights in or to any aspect of the Intellectual Property other than the limited right to use the Intellectual Property in accordance with these Terms (including the Licence).
You are provided with access to RErights for your personal and non-commercial use only. You may not at any time, commercialise any information, materials or services obtained from any part of RErights or our affiliates.
WITHDRAWAL FROM PROJECT
Participation in the RErights research is voluntary and you can withdraw from the study at any time without impacting your relationship with us.

RErights will use its reasonable endeavours to meet all requests for the deletion of content submitted by you prior to withdrawal. All requests for the deletion of any data and content that you have uploaded must be specified in your email. Please note that where content has already been published in accordance with these Terms, then we may not be able to re-edit the content.
To the extent permitted by law, we will in no way be liable to you or anyone else for any loss or damage, however caused (and whether direct, indirect, consequential or economic) which may be directly or indirectly suffered in connection with use or access to RErights in whatever form.
All information provided by RErights is done so in good faith and on an ‘as is’ basis. We make no representation or warranty as to the reliability, accuracy or completeness of the information, or that your use of RErights will be uninterrupted or error free. You must make your own assessment of the information provided and, if you choose to rely on it, it is wholly at your own risk.
The content contained on the RErights website does not necessarily reflect the views or opinions of RErights or its partner organisations.
We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with your use of RErights. You must take your own precautions to ensure that whatever you select for your use of RErights is free of viruses or anything else (such as worms or trojan horses) that may interfere with or damage the operations of your computer systems.
We may, from time to time, change or add to RErights without notice. We do not undertake to continuously keep our websites or any social media sites updated and we are not liable to you or anyone else if errors occur in the information provided.
We may terminate or suspend access to RErights immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
To the extent permitted by law, all implied conditions, representations, warranties and other terms are excluded. Further, RErights and all its affiliates, directors, officers, employees and agents exclude all liability for any loss, damage (including, without limitation, direct, indirect, special or consequential loss or loss of profits) you suffer, whether arising under contract, tort (including negligence), equity, statute or any other cause of action, as a result of using or accessing RErights or any content, information, materials or services available from RErights. These Terms are governed by and to be interpreted in accordance with the laws in force in Victoria and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts having jurisdiction there.
If any of these Terms is invalid, unenforceable or illegal, that term will be struck out for the jurisdiction only in which it is invalid, unenforceable or illegal and the remaining terms will remain in full force.
